They do not pay old-age pensions. How the future pension is formed and calculated. Appealing and protecting your rights in court

The abolition of pension indexation was not approved by the active part of older people. They felt that their rights were being violated. But it turned out that there is a “loophole” in the law for this case too. It is possible to avoid losses from the new pension reform in the current conditions.

Russia's budget is not unlimited. Since there are more pensioners than young taxpayers, the Government has taken drastic measures. The new policy in no way affected those people who retired after reaching retirement age.

Employment of a pensioner: registration, advantages, disadvantages

  • passport;
  • retirement certificate;
  • documents on received education and advanced training;
  • registration certificate with the Pension Fund of Russia;
  • work book;
  • medical certificate confirming passing a professional commission;
  • TIN, if available;
  • salary certificate from the last workplace.

The question of whether it is beneficial for pensioners to work officially worries many Russians who would like to continue working after reaching retirement age. In order to determine whether this option is economically acceptable, you should familiarize yourself with all the nuances of employment of persons on pension benefits.

How much money does a working pensioner lose?

4) Social supplement to pension (federal or regional). These payments are assigned in cases where the total amount of social security received by the pensioner does not reach the minimum subsistence level approved for the corresponding region of residence of the pensioner.

In addition, the recalculation was introduced without a declaration, for everyone - from August 1. That is, those who worked a full calendar year from January to December receive an increase in their pension for this year only 7 months later - in August, losing money for the previous period from January to July.

To work in retirement or not

In accordance with Article 25 of Law dated December 28, 2013 No. 400-FZ “About insurance pensions”, the survivor's pension will be terminated upon official employment or resumption labor activity, for which insurance premiums for compulsory pension insurance will be transferred to the Pension Fund. To the category of such citizens relate:

After reaching retirement age, a citizen can leave his job at his own request in connection with retirement. According to the Labor Code Russian Federation, according to Article 80, an application for dismissal on the employee’s own initiative in connection with retirement may serve to terminate the employment contract within the period specified in it.

Do you need to work in retirement?

  • The Pension Fund will provide information for calculation; data provided by insured citizens and policyholders will be taken into account.
  • If the bill is approved, then only a small percentage of pensioners who work will have to fear cancellation of pension payments.
  • A bill was being developed to abolish pensions in order to balance the Russian pension system and ensure the financial stability of the country.

Today it is impossible to give a clear answer whether it is beneficial or not for a person who has retired to continue working. On the one hand, this gives monetary increase to his financial situation, but on the other hand, you should not expect a special increase in the amount of your pension benefit.

Pensions for working pensioners in 2019: latest news on indexation of payments

An increase in pensions in 2019 will be made to everyone who receives payments below the regional subsistence level and whose salary is below 18,000 rubles. In addition, such citizens can count on recalculation. It is produced upon request. In 2019, the state will deny bonuses to those persons whose total salary for the year will be more than 1 million rubles. Average today minimum pension— 8803 rubles.

All of the above persons have the right to count on the protection and support of the state. If we talk about the retirement age, in Russia it has remained unchanged for many years. Women retire at age 60, men at 65. Long-service benefits are received by military personnel, cosmonauts, civil servants, testers, pilots, medical workers who have worked for the state for more than 20–25 years.

Recalculation of pension after dismissal of a working pensioner

Moreover, in 2019, there was a special procedure for recalculating pensions after the dismissal of a working pensioner. For example, if a citizen quit on December 29, 2019, then he will begin to receive an indexed pension only after three months, that is, from March 29, 2019. Such instructions are contained in paragraphs 6 and 7 of Art. 3 of Law No. 358-FZ of December 29, 2015 (as amended on November 22, 2019).

  • the amount of calculated and transferred insurance premiums on the citizen’s individual personal account;
  • the sum of all periods of labor activity for which contributions were made;
  • number of accrued (earned) pension points;
  • personal (individual) pension coefficient;
  • the total indexation coefficient established by current legislation.

Pension for working pensioners in 2019

The category of working pensioners includes persons for whom employers pay insurance premiums and who carried out official labor activities as of the last day of the reporting campaign for employers to submit personalized accounting information to the Pension Fund.

In accordance with changes in pension legislation, since 2019, working pensioners receive an insurance pension and a fixed payment to it without taking into account planned indexations. This provision of law applies only to recipients of insurance pensions (including fixed payments) and does not apply to recipients of state pensions, including social pensions. In 2019, working pensioners will also remain without pension indexation.

About the amount of old-age pension without work experience

Is an old-age pension available to citizens without length of service? In order to receive good payments in the future, you need to work a certain number of years. That is, to begin with, you work for the state and pay taxes, and then you are entitled to a certain pension. If you worked in an official job, you have nothing to worry about - you have seniority. But for the unemployed, things are somewhat different, because they do not have official work activity. First, you work for the state, and only then can you count on receiving pension money.

Will there be a pension if living conditions change? The social pension can be canceled if a person moves to another country, receives a second citizenship, or gets an official job. At the same time, the insurance pension in such cases continues to be paid, because it is calculated somewhat differently. You can only receive a social pension when you are in your home country. While you are working, you are not entitled to pension benefits from such a plan.

CAN A WORKING PENSIONER QUIT FOR PENSION INDEXATION AND GET EMPLOYED AGAIN

However, please note important detail: In order for the Pension Fund to index the pension according to reporting documents from employers, the person must be unemployed. It takes up to three months to obtain all this data. Therefore, during this period (3 months) there is no point in getting a job. After all, if you quit and, for example, get a job again a week later, then “in the eyes” of the Pension Fund of Russia the person will continue to be listed as employed. And then there will be no indexing.

If the pensioner decides to resign, the amount of his pension will be immediately revised. As soon as the pensioner decides to “wind down” his work activity and retire, his payments will be recalculated taking into account all increases from the state that occurred over the past periods while the moratorium was in place.
Pensioners will immediately undergo all past indexations, bringing their pensions to the level of non-working pensioners. Plus what the pensioner earned while he was working while retired.

07 Jul 2018 1930

In March 2017, real incomes of the population jumped by 8%. This news could have pleased economists, if not for one fact - the growth occurred against the backdrop of a one-time payment of 5,000 rubles to pensioners. There is no word yet on whether lump sum payments will be made in 2017/2018. However, already in April the figure for real incomes of the population decreased by 7.6% compared to last year. These data are provided by Rosstat in a monthly report.

One-time payment to pensioners in 2018: is it worth the wait?

If we consider the government's capabilities, pensioners should hardly expect an increase in 2018. The budget deficit is approaching 3%, oil prices are unwilling to rise, and another industrial decline of 2.7% reduces tax revenues.

The reserve fund has almost run out; the National Welfare Fund in current conditions will last for a maximum of 2 years. However, there is one more important nuance. Elections will take place on March 18, 2018, and the votes of 37,083,000 people are very important for the principle of legitimacy.

Therefore, the government will do everything to ensure that a lump sum payment to pensioners in 2018 is made under any conditions, even if this means diving into reserves or simply printing the required amount of money.

After the freezing of pension savings and the practical abolition of the funded part of the pension, the state is relatively successfully meeting its obligations, although it is not able to create reserves for future generations.

What to expect after 2018

According to the head of the Pension Fund of the Russian Federation, the average payment per pensioner in 2017 will be 164,400 rubles. That is, with official inflation of 4.13%, everyone would have to receive 6,789 rubles. A simple calculation says that the state managed to save about 65 billion by replacing indexation with a one-time payment. Since the elderly and disabled reacted calmly to such an initiative for the first time, there is a high probability of a repetition of the already tested scenario.

In the country, for every 78 million workers there are 37 million pensioners, the ratio is approaching 2:1. The pension fund's deficit is 182 billion rubles, its income is 8.23 trillion rubles, and its expenses are 8.5 trillion rubles. A year earlier, the deficit was 7 billion less, and if not for the replacement maneuver, the difference would have been 72 billion. Moreover, in 2018, the gap would have increased even more, since inflation would have had to be taken into account for two years.

Now there are disputes in the government over the budget; the head of the Ministry of Finance is demanding that the fixed portion, which now amounts to 4,800 rubles, be paid directly from the budget. The Ministry of Labor categorically objects to this. At the same time, all parties agree on the need to raise the retirement age; only such a step will balance the Pension Fund of the Russian Federation.

But no innovations can be expected before the elections; social tension is already growing. The president will not allow the situation to worsen on the eve of an important event.

Therefore, whether the payment to pensioners in 2018 will be in the amount of 5,000 rubles, or whether the amount will have to be changed, will be seen closer to the elections. The 220 billion that will be required for a one-time payment is not such an unaffordable amount. 638 billion have been allocated for preparations for the 2018 FIFA World Cup.

Russians don't want to retire, they want to work. Therefore, they decided to raise the retirement age from 2019. What will happen to pensions and to us? Briefly - about the main thing.

Insurance pension

From 2019, a transition period will begin to raise the retirement age in order to gradually reach retirement at 65 years for men in 2028 and 63 years for women in 2034. If you have already reached pre-retirement age and are, so to speak, at a low start, you will have to slow down. For how much - look in the tables.

Women's retirement:

Year of birth

Year of retirement

Retirement age

Increasing age

Men's retirement:

Year of birth

Year of retirement

Increasing age

Social pension

The wait for social pension will be even longer. Let us remind you that social pension assigned to those who have not accumulated the required number of pension points or have not completed the minimum length of service.

After completion of the reform, the old-age social pension will be assigned to women not at the age of 60, as now, but at 68 . And for men - not at 65 years old, but at 70 . At the same time, the increase in the age for assigning social pensions will be carried out in stages.

Our financial columnist Alexandra Bayazitova counted:

Raising the retirement age ensures that at current prices the authorities annually save 168 thousand rubles for each failed pensioner. That is, this is the seizure of 840 thousand rubles from each man and 1 million 344 thousand from each woman.

Early retirement

Prime Minister Dmitry Medvedev promised that existing benefits for early retirement will be maintained.

This right will remain for those who work in harmful and dangerous industries, women who have five or more children, visually impaired people of the first group and due to military trauma, one of the parents or guardians of a disabled child, Chernobyl victims and “certain other categories.”

Requirements for the experience of teachers, medical and creative workers are also proposed to remain the same. Now these categories of workers need to develop a special length of service from 15 to 30 years, depending on the specific category of employee for benefits. These rules will remain unchanged during this period. At the same time, the retirement age of these workers will be calculated taking into account general approaches to the rate of increase in the retirement age.

For those who worked in special climatic conditions, regions of the Far North, and similar areas, retirement will be achieved step by step for men at 60 years of age and for women at 58 years of age.

In addition, citizens who have significant experience already earned during the period when the retirement age for women was set at 55 and for men at 60 will be given the opportunity to leave early (two years earlier) - 40 and 45 years of experience, respectively.

Pension amount

Due to the fact that retirement is delayed and the working age is increased, the pensions of current pensioners will increase. The growth rate will be approximately 1000 rubles per year. How do you think the game is worth the candle?

Why and why

“We have been preparing for a long time to increase the retirement age and have only now approached this, including because the conditions have been created to solve the problem of increasing life expectancy,” said Dmitry Medvedev.

Nowadays people not only live longer, they stay active longer. Many at retirement age are full of strength and desire to work; many have children who have not even grown up yet. The number of working pensioners on average per year is about 12 million people.

They don't want to retire, they continue to work.

And every year this trend will only intensify, noted Dmitry Medvedev.

If citizens want to work, they must work, especially since the income from such work is always higher than a pension, the Prime Minister added. Employers must fully provide jobs for older people.

Deputy Prime Minister Tatyana Golikova explained that the goal of all decisions that are made is to increase pension provision in the long term.

And one more thing, for history:

The Russian state, by law, pays pensions even to those citizens who have never worked. Let's take a closer look at what the grounds are for this, and in what amount the pension is provided in this case.

Will there be a pension if there is no work experience?

When answering the question - what will the pension be if a person did not work, one should reveal in more detail the essence of the phrase “did not work”. The following interpretations are possible here:

The man “didn’t work” in principle - he was idle

Oddly enough, a citizen who has never had work experience - for reasons dependent or independent of him, has the right to ask a difficult question - is there a pension if he has not worked, and to expect in some cases that his pension will be no less than that of a citizen who has had experience.

The person did not work officially

That is, I received my salary “in an envelope”, and pension contributions were not deducted from it to the Pension Fund of the Russian Federation or to the Non-State Pension Fund. He also has the right to a pension - but absolutely on an equal basis with a person who allowed himself not to work in principle.

At the time of retirement age, a person does not have sufficient experience and the required number of points to receive a pension.

And here the principle of assigning a pension is similar. In fact, a pension without work experience and points collected in the required amount is equivalent to the pension of a person who has not worked at all, or who has not officially worked.

The person was not employed, but was engaged in entrepreneurial activity

Here we need to make a distinction:

  • activities in which contributions were paid to the Pension Fund (fixed contributions of individual entrepreneurs) - in this case there is no question of a pension without length of service (unless, of course, the length of service is in the required amount, as are pension points calculated on the basis of contributions);
  • activities for which contributions were not deducted (for example, if a citizen simply owned a share in an LLC and received dividends).

In the second case, you can already wonder whether there will be a pension if you have never worked. From the point of view of pension legislation, an entrepreneur who receives income from which contributions are not paid is a non-working citizen. This also includes income from trading currencies and securities.

One way or another, in all of these cases, the answer to the question - is there a pension if you have never worked (in fact or from the point of view of pension legislation) will be positive. True, the assignment of a pension in this case has special conditions.

What are the conditions for receiving a pension without work experience?

The right to a regular old-age retirement pension - which is assigned with sufficient length of service - in 2018 arises for a person upon reaching the age of 60 years (men) or 55 years (women). An old-age pension without work experience is assigned 5 years later. This pension is called “social old age pension”. The legislation does not provide for other conditions for receiving it. Any minimum experience requirements ( pension points) No. And the fact that you have experience, but are a little short of what is required for a regular pension, doesn’t matter either.

Of course, the size of the usual labor pension for old age and pension without work experience in Russia may not be comparable (especially if there is a lot of real work experience and a good salary). But in many cases this is not entirely true, which is explained by the specifics of calculating a pension for a non-working person.

How is a pension calculated without work experience?

So, we have refuted the widespread thesis - if you don’t officially work, then there will be no pension. It will be, but, firstly, as we already know, much later than the usual pension, and secondly, in a different - usually smaller - amount.

The amount of pension for a citizen who did not work (who did not pay contributions from his income) is determined by following rules:

Read also Remote consulting and provision of services for citizens in the Pension Fund of Russia

What the pension will be if there is no work experience depends on the amount of the minimum (social) pension established by law

Now its value is 5240.65 rubles. It is the same regardless of the category of the recipient.

The social pension in the amount indicated above is indexed annually by the state

Thus, what the pension will be if there is no work experience depends on the level of inflation (it is this that is taken into account during indexation).

The social pension, taking into account indexation, can be increased due to the regional coefficient - if a person, for example, lives in the Far North or an equivalent territory

Thus, how much the pension will be if there is no work experience may also depend on the region of residence of the citizen.

If the social pension calculated under points 1-3 does not reach the level of the subsistence minimum established by the region, then the state pays the citizen the amount necessary to bring the pension to the appropriate level

Thus, the final reference point for the retirement income of a person who is thinking about whether there will be a pension if he has not worked all his life is the subsistence minimum established in the constituent entity of the Russian Federation in which he lives. Note that the cost of living for a pensioner is, as a rule, noticeably lower than that established for an ordinary citizen.

Summary “Q&A”

Let us now summarize the above.

If a person does not work, will he receive a pension?

Yes, but 5 years later and in an amount that does not exceed the subsistence level in the region. But according to the law, the pension cannot be less than this amount. As inflation occurs, the minimum pension is indexed by the state and retains its purchasing power.

Will there be a pension if I don’t work officially?

The rule is similar here. Lack of official income pension legislation is equivalent to non-exercise of labor activity. The main criterion here is the availability of contributions from the citizen’s salary. There are contributions - the pension period is in progress.

Entitled to all other pensioners. The state considered this fair to working pensioners and a more profitable option for reducing the expenditures of the Pension Fund budget.

Previously, the government was discussing the issue and receiving specific decisions on this proposal from the Ministry of Finance and other government bodies, for example, it was proposed cancel payment fixed part of the pension. However, at the moment, the government has not announced any specific decisions.

Is it possible for a pensioner to work and receive a pension?

Upon reaching retirement age, not all citizens want to leave the workplace and spend time at home. On the contrary, pensioners find additional part-time work or remain in official employment.

In the Russian Federation, it is possible to remain in retirement with a monthly payment and work officially, simultaneously receiving a salary with her.

  • The Government's proposal to reduce pensions for working pensioners in order to save the Pension Fund budget, presented back in 2015, did not find support, so at the moment, while continuing to work, the pensioner old age pension is not deprived.
  • However, some citizens applying for a survivor's pension can count on it while continuing to work, in accordance with clause 2, part 2, article 10 of the law of December 28, 2013 No. 400-FZ “About insurance pensions”, since this type of payment can only be received disabled a close relative of the deceased who was his dependent.

The state is trying in every possible way to stimulate the population to more late retirement, refusing payment, offering increase its size.

Is it profitable to work in retirement?

Receiving both a pension and salary at the same time is much more profitable and, of course, significantly increases the financial security of a pensioner. In addition, by continuing to increase your length of service upon retirement, you can benefit yourself, since insurance premiums and the amount of pension savings also increase, which means the payment itself also increases. In this regard, an annual event is held.

However, at the moment it is known for sure that such decisions will not be made in the near future.

Survivor's pension if you work

You can postpone retirement for a minimum of one year, and the maximum bonus factor is accrued for 10 years. Tables of correspondence between the bonus coefficient and the deferment period are posted in the appendices and to the law of December 28, 2013 No. 400-FZ “About insurance pensions”. It can be concluded that the longer the deferment period, the higher size future pension provision. For example, if you defer for a year, the pension amount will increase by 6.5%; with a delay of 5 years - already by 40%.
